Overview

Indiana has an anti-boycott law in effect that prohibits state investment in entities that boycott for Palestinian rights. Signed into law in 2016, the bill requires the Indiana Public Retirement System to create a blacklist of companies engaging in such boycotts and divest from such companies. Indiana’s House and Senate have each passed non-binding resolutions, both of which denounce BDS, specifically academic boycotts for Palestinian rights, and conflate criticism of Israel with antisemitism.

HB 1037 is an antisemitism redefinition bill that adopts the distorted IHRA definition of antisemitism, including its contemporary examples that target advocacy for Palestinian rights, into Indiana law applying to public schools and higher education institutions. The introduced version of this bill referred to the definition of antisemitism found in a 2010 Department of State factsheet that is substantially similar to the IHRA definition.

This anti-boycott law requires the Indiana public retirement system board of trustees to create a blacklist of for-profit businesses that engage or acquiesce in efforts to “limit commercial relations with the Jewish state of Israel or businesses that are based in the Jewish state of Israel or territories controlled by the Jewish state of Israel.” The law requires public retirement funds to divest direct holdings from blacklisted companies. The preambular language smears BDS campaigns as damaging to peace and justice, harmful for Palestinian workers, and creating a climate of fear on Indiana’s college campuses.
