Anti-boycott

This anti-boycott executive order prohibits state contracts unless they include a written certification that the contractor is not and will not for the duration of the contract engage in a “boycott of a person or an entity based in or doing business with a jurisdiction with which Kentucky can enjoy open trade.” The preambular language makes clear that the order is aimed at punishing boycotts for Palestinian rights, falsely claiming that BDS campaigns targeting Israel’s human rights violations amount to unlawful discrimination. 

During the signing ceremony, the governor said that Israeli Prime Minister Benjamin Netanyahu personally asked him to sign the measure after the state legislature refused to pass similar legislation earlier that year.

This anti-boycott law prohibits state contracts with for-profit entities that boycott Israel or territories occupied by Israel. The law requires contractors to sign a written certification that they are not engaged in a boycott of goods or services from Israel that form an integral part of the state contract. It excludes contracts worth less than $100,000 and contracts with individuals. The law also prohibits the state from adopting policies that require a boycott of Israel or territories occupied by Israel.

This anti-boycott bill prohibits state contracts with and state investment in entities, including sole proprietorships and non-profits, that boycott Israel or territories occupied by Israel. The bill requires contractors to sign a written certification that they do not and will not engage in boycotts of Israel. It excludes contracts worth less than $1,000 or contractors who bid at least 20% less than other bidders. The bill calls for the creation of a blacklist of companies that boycott Israel and prohibits Oklahoma public retirement systems from investing in these companies. It also prohibits Oklahoma public entities from boycotting Israel, a provision aimed at discouraging divestment campaigns at public universities.

This anti-boycott law prohibits state contracts with companies, including sole proprietors, unless the contract includes a written certification that the company does not and will not for the duration of the contract engage in a boycott of any jurisdiction with whom Ohio can enjoy open trade, including Israel and the territories it occupies. Although the law as written should not reach boycotts for justice, HB 476 is clearly intended to target boycotts for Palestinian rights, in particular.

Although this bill was defeated, the companion bill HB 161 was passed.

This anti-boycott bill requires state pension funds to withdraw investments from companies that boycott Israel, entities doing business with Israel, or entities in Israel or territories it occupies. The bill requires the state to create a blacklist of companies that boycott Israel. Though the bill failed, its companion bill S1923 was enacted in 2016.

This anti-boycott bill prohibits state investment in companies that boycott goods, products or businesses of Israel. The bill requires the state to create a blacklist of all investments that violate this prohibition. The bill makes an exception for companies providing humanitarian aid to the Palestinian people. This anti-boycott bill defunds state institutions of higher education that directly or indirectly fund academic entities or associations that boycott, condemn, or otherwise oppose businesses, institutions, academic personnel, public officials, or actions of the state of Israel.
