Read SB 86 

This anti-boycott law prohibits state contracts with and state investment in companies, including sole proprietorships, that boycott Israel or persons or entities doing business in Israel or territories it occupies. The law requires the creation of a blacklist of companies engaged in prohibited boycotts. Public funds are prohibited from investing in blacklisted entities. State agencies and local governing authorities may not enter into contracts worth $1,000,000 or more with blacklisted companies. Contractors must provide written certification that they are not engaging in prohibited boycotts. The penalty for false certification is the greater of $2 million or twice the amount of the contract in addition to a 3-year ban on bidding. Related Bills: HB 527, HB 199.

This anti-boycott law prohibits state contracts with entities that boycott persons or entities doing business with and in places where Kentucky enjoys “open trade.” The law requires written certification that the contractor is not and will not for the duration of the contract engage in such a boycott. The law is narrower than the anti-boycott executive order signed by the governor in 2018 and excludes individual contractors, those with fewer than five employees, and contracts valued at less than $100,000 from the requirements. This anti-boycott executive order prohibits state contracts unless they include a written certification that the contractor is not and will not for the duration of the contract engage in a “boycott of a person or an entity based in or doing business with a jurisdiction with which Kentucky can enjoy open trade.” The preambular language makes clear that the order is aimed at punishing boycotts for Palestinian rights, falsely claiming that BDS campaigns targeting Israel’s human rights violations amount to unlawful discrimination. 

During the signing ceremony, the governor said that Israeli Prime Minister Benjamin Netanyahu personally asked him to sign the measure after the state legislature refused to pass similar legislation earlier that year.

The resolution falsely links boycotts for justice with rising antisemitism, claiming that such accountability efforts are “legitimizing” antisemitism on college campuses. The resolution was amended to add language also condemning “white nationalist, neo-Nazi, and national socialist groups,” thereby conflating BDS campaigns seeking justice with those that promote hate, persecution, and violence.

This anti-boycott law prohibits state contracts with companies, including sole proprietors, unless the contract includes a written certification that the company does not and will not for the duration of the contract engage in a boycott of any jurisdiction with whom Ohio can enjoy open trade, including Israel and the territories it occupies. Although the law as written should not reach boycotts for justice, HB 476 is clearly intended to target boycotts for Palestinian rights, in particular.

This anti-boycott law prohibits state contracts with and state investment in entities, including sole proprietorships, that boycott Israel or territories occupied by Israel. The law creates a blacklist of restricted companies and prohibits the state from investing in or entering into contracts worth over $1,000 with companies on the blacklist. Entities can be removed from the blacklist if they provide a written certification that they will not reengage in a boycott of Israel for the duration of any business with the state. The law excludes boycotts that have an economic impact of less than $20 million per year. Related bill: SB 329.
